Blotter: Landlord Arrested for Trespassing Own Property

In another incident, littering led to the arrest of a suspect.

The following arrest information was provided by the Stratford Police Department. It does not indicate convictions.

A local property owner involved in a tenant-landlord dispute was arrested for trespassing in her own house.

Police reports said they received a complaint by a female tenant at 54 Kenyon Street that the landlord, Andrea Janucik, 72, of 1469 Nichols Avenue, Stratford, had violated a court order and gone into the Kenyon Street home without notifying the tenant.

Police said Janucik is in the process of evicting the tenant, and that the tenant had made numerous complaints against her to police. During the eviction process, the Housing Court magistrate has ordered Janucik not to enter the house without notifying the tenant in advance. Janucik was charged with criminal trespass and released on a promise to appear at a Sept. 9 court appearance.

Littering leads to other charges

Littering was a bad idea for a Monroe resident, who wound up getting arrested by Stratford police on several PRAWN warrants.

Jonathan Rodriguez, 26, of 327 Fan Hill Road, Monroe, was a passenger in a car on Aug. 31 at 7:19 p.m. when a Stratford police officer observed the vehicle make a turn from Anderson Street onto Drome Avenue without signaling. The car also had a broken taillight.

Police reports said as the officer signaled for the car to pull over, he saw the passenger, Rodriguez, throw a cigarette package out the window. The driver, Mark Warcholic, 23, of 62 Roosevelt Avenue, Stratford, was issued infractions for failure to have a stop lamp and no turn signal. When the officer told Rodriguez he would get a ticket for littering, Rodriguez gave the officer an ID that a computer check revealed was a false identification.

He finally admitted his true identity, and another computer check showed he was wanted on two court-issued PRAWN warrants, by the Milford police for failure to appear in the second degree and by the State Police for a probation violation. In addition, Rodriguez was charged with interfering with a police officer and received the littering infraction. He was held on $10,500 bond for a court appearance on Sept. 13 in Milford Superior Court.

Police charge hit-and-run driver

Stratford police charged a local resident on Aug. 30 with speeding and other violations following a hit-and-run accident on Light Street.

An officer was dispatched to the scene at 10:05 a.m. after police received a call from a resident that someone had hit a parked car. The driver left the scene and continued toward the dead end of Light Street while the owner of the parked car blocked the street.

Police reports identified the driver as Ashley Minutolo, 21, of 782 Light Street, Stratford. She told officers that she was arguing with her boyfriend when she lost control of the vehicle and hit the parked car. Other residents said she was driving at an excessive speed on the congested street where children were playing. Police also determined that her drivers license was suspended.

Police charged Minutolo with traveling too fast for conditions, failure to drive right, evading responsibility for property damage, and operating under suspension. She was released on $50 bond for court on Sept. 13.

In regard to trespassing article, there was no court order.The tenant misrepresented herself, in that she did not inform the landlord,of her boyfriend,(guest) living in one room w/ three,to four Children sleeping on an air mattress on the floor in same room.Here is a situation of a tenant making numerous,unexpected,false complaints against the Landlord for their own adgenda.The tenant demands of the landlord, that she be called specifically,if, she is home or, not regardless of the calls made each, & every time the Landlord called the three other tenants advising them of need to enter the dwelling,for either their needs, or, repairs.The tenant did not rent the whole house,& garage, for $150.00 a week, utilities included,.She rented 'one' room.Two tenants have vacated due to above tenants, sloveness,& takeover behavior.The tenant has not paid rent since August 21-2011. Previous to this tenant, progress was being made on improvements to the house, & there was never any problem w/ any other tenant.In fact, any other tenants have been pleasant,& helpful.

when an incident like this occurs,it can be extremely traumatizing,when having to face both the Police, & complaining tenant. In the trauma during the event taking place,the Landlord is open to making mistakes in their answers to the Police Dept.while it is being established if, the Landlord does,or, does not, live at 54 Kenyon St.It was quite intimidating.Actually yes, we do live there at 54 Kenyon St., dividing our time between two homes.Our second address 'is' 54 Kenyon St. Hearing the tenants loud arguments w/ her boyfriend,or,she, & the boyfriend arguing w/ us,& other tenants, should have been cause for 'us' to call the Polce Dept. Yet, not wanting additional upset, we did not. The complaining tenant has taken advantage & created a worse situation. If, the complaining tenant is not aware of the Landlords' agreement w/ any other tenant to meet in the dwelling,it seems unreasonable for the complaining tenant to come out of their room, & go out to the St.& covertly call Police Dept. Also, there seems to be a disparity between instructions given by different Officers. We were told at one time that we certainly 'were allowed' to be at his address, and, at another time told not to enter the address,& under threat of arrest if, we did. For the Landlord, this has become a convoluted mess of misinformation,half truths,& false information from the tenant to be evicted.The Landlords are elderly, & disabled,& well liked by all other tenants.

To think this all happened because, a roomer,& boyfriend continued to use the garage for a motorcycle, after we advised them not to for their own safety due to a faulty garage door opener needing repair, along w/our not being in agreement w/ having 3-4 Children sleeping in their room,arguing w/ other tenants,& sloveness. If, any one reading the comments has had a similar problem, we'd apreciate your comments Thanks

Because, we felt it was best to modify a problem from within,privately,& responsibly w/ new tenant, we did not call the PD when that tenant argued,& continued to allow her guest to use it. With the many requests given to the tenant,boyfriend, concerning too many people in one room,that was ignored also,& still we did not call the PD when we were subjected to their arguing w/ us over it.

So, it seems the offending party will use the tactic, & ploy,of calling the PD,will give false information,to further their own adgenda. That adgenda is to secure housing under false pretenses.The tenants boyfreind told us, he would be renting the whole house! That his mothers' house on East side of Bpt. is better! Now, we have a derelict vehicle w/ a flat tire sitting in driveway at house,& house turned upside down,after so much labor to make it a pleasant place! & possibly economically impossible for us

Further, we are not of the character to violate a Magistrate, Court Order,or, Police officers orders.We've contacted Jason Bagley of Strfd. Patch, to consider our request to take down embarrassing,disparaging incomplete,news item for us.He will ask his Superior to honor our request. We are very open to the truth in this matter,& if, publicly defending our selves is necessary, so be it.

This was so unfair to the landlady. Ther are people out there that are users and the tenant appears to be one of these people. I was raised that your word is your bond and it is very clear this girl's word has no value. She violated her rental contract when she allowed her boyfriend to move in with her and put her children in there also and they were sleeping on the floor while she and boyfriend shared the bed. I feel sorry for the landlady and she being a senior citizen should not have had to endure this article in the paper as well endure such disrespect from a tenant.

Thank You Donna for your comment. When I look back on it all now, I realize how the tenant called the Police Dept.& lied about harrassment. There never was an incident of harrassment, ever. If,any thing , I tried to help her, & suggested the Ctr for Women Children & Families. But no, she did'nt want to do that. Thank You, again

You are welcome Andrea. I just do not understand how a tenant can get away with telling lies to the PD and the landlady cannot say anything. I think any judge would see this for what it is. A girl that will use others for her own gain always in the end will be found out.

The more I think about this incident I have to say I also am a senior and have never had to endure this kind of thing from anyone. Just dont let this girl get to you. I appears she has no respect for seniors let alone for herself because of the lies she has told.

Having read this artical over again,it should be said,this case has never been in Court.There was no harrassment.Actually,after the tenants 1st call to the PD Dept., there was no sight of her in the dwelling, no confrontation, no dialogue, as her room is at the far end of the house.The tenant did not know of my contact w/ other tenants concerning theirs, & my business w/ them.Once a 1st call was made by her, she made false statements thereafter. Concerning a modem, & router in her room, was another false statement, as she gave permission to me, & requested her 11 yr. old Daughter to help me remove it, after the tenant,& boyfriend had disconnected it.

Another 2nd. tenant in another room was willing to set up the internet again in their room,& for safe keeping.The same 2nd. tenant had to remove their DVD player also, to their room, as the tenant being evicted,& boyfriend had tampered w/ their DVD Player also.The tenant being evicted made no attempt to respect any one else's property,or get along peacefully. There should have been no reason for the tenant to be evicted, to come out of their room,snooping to see that I were there in the dwelling,to address other business,only to call the PD Dept. Contact w/ this tenant was most definitly avoided.The Landlord was advised by the PD Dept. to use only one bedrom, & Sunroom for themselves, after so many calls, which is what we did,& 'still' another call was made by the tenant, that we were in the house.

When the Landlord peacefully requested the tenant, & boyfriend remove their cars from driveway,so that the garage not be blocked to a truck delivering a bed, 'still' another call was made by the tenant to PD after the Landlord left. A considerate, reasonable individual would not make so many calls when the Landlord has done nothing to deserve it. It seems the more calls an individual makes to a Police Dept.,that individual is trying to make a case against the Landlord, warrented,or, not.

When a new bed was delivered to new 2nd tenant, the new tenant was called,& advised of it's delivery.The new 2nd tenant, a friendly person, invited us to inspect it in their room,& we accepted. There was no indication the tenant to be evicted, was on the premises. The tenant to be evicted came out of her room, went out side, & called the PD Dept again!This is when the Landlord was arrested. Again, there was no dialogue w/ her, no confrontation.Hopefully, a Housing Court Proceeding will ameliorate this upsetting, economically,& time consuming problem, & we will be able to go back to living at this address again, & completing the work necessary,& regain normalcy.That is all yet to be determined by a Judge.For now, since the initial shock,& soreness we've felt is past, we'll refrain from any further comment.But should any one still be interested in the out come, we are open to further commnts.

I have known Andrea for a very long time and have never ever known her to be a trouble maker or be unkind to other people. Andrea has always tried to help others and has a very understanding heart never to harm anyone. We do feel so sad that this has happened to a realy great lady.

Andrea rented a room to me and was wonderful to deal with. She treated me like her own daughter. The two women living there are users and play the system. I moved out to get away from the other tenants. They are rude and cannot pay there own rent. It is sad that they have more rights than the landlord. Instead of arresting a good woman, the two uncaring tenants should be put out of the house. I left a decent place to live due to people who cannot be trusted. Andrea is missed by me and it makes me sick that these girls are using her. Janet jacoby

Hi Janet, & Thank you for your comment.It's old news now, so, I doubt any one else is interested any more, but, Thank you just the same.It was a tough thing to bear when it was insisted upon by people called to that address, that, we don't live there, when yes, out of necessity, we lived in Sunporch,Back bedroom, kitchen, & living room, while upkeep issues were underway,& in fact had called tenants any time we were to be there, as you know. It is in fact also our 2nd legal address.I am so sorry you had to move out, & I certainly miss you too. I had to accept what ever was being told to me,during those calls, & not refute it as best I could, so as not to be disrespectful w/ those concerned at the time.

Janet, I meant to say, whenever we are allowed to return to our house again,I will let you know, so that you're able to retrieve the rest of your belongings.The 2nd newer tenant shorted on their rent last week, & there's been none paid as of yet, so, we'll see how this all works out.The 2nd tenant called me to say the cellar has flooded, & the pump is not working,& they can't now do their laundry, so, we need to get back to business ASAP. Again,Thank you, & I'm so sorry you, & your Daughter were not able to enjoy living there.

I have to say that these two women are using andrea and need to be kicked out. They will stay as long as they can. The courts need to get involved. These women see nothing wrong in what they are doing! Sick people

I recall now, that the tenant who called the police Dept so many times, called them again because, I was in back yard, & was called into the house, to come to the front door. It's too bad any one would do that, but, it's past now. Very traumatizing event.
