Fred Acker Animal Cruelty Trial -- Save the Date to Demonstrate

Calling on people to demonstrate in Litchfield at the town green across from the courthouse on Dec. 12 at 9 a.m.

SAVE THE DATE: Dec. 12, 2012, 9 a.m. Litchfield Town Green. This is the date and place where Fred Acker will begin his trial for 62 counts of felony animal cruelty.

For anyone who is not aware of Fred Acker or did not read my first blog, he has been in the dog placement business, in lower Fairfield County for approximately 20 years. He goes under the name of SPCA of Connecticut and his logo looks almost identical to the logo of the ASPCA of New york. He is not now nor has he ever been associated with the ASPCA, which has been in business in New York for over 145 years. ASPCA stands for Association for the Prevention of Cruelty to Animals.

Over the past 13 years, Acker's business has been located in Monroe, CT and over the years he has been cited by local and State animal control for various infractions of State Laws pertaining to animals. He obtains dogs from "puppy mills" down South at very small fees, has them shipped to Connectcut, and sells them for $395.00 per dog. He has bragged to Channel 8 News that he has "placed" 360 dogs during one three day period when he actually sold these dogs to unsuspecting people and collected over $100,000.00 in fees. The amounts of money he has made during this 13 year period must be mind boggling.

Due to presure from local and State animal control, Acker recently moved his "business" to Bethlehem CT, where he is renovating a barn to be used to house the dogs he has obtained for sale.

On Oct. 11, the Bethlehem Animal Control Officer (ACO) recieved a complaint regarding a dog that had escaped from this building. The dog was later found dead on the highway. While investigating Acker, the ACO found several discrepencies in the information and paper work that Acker produced, vet info, rabies certificates, etc. At that time there were 76 dogs, in crates, in the barn. The Officer issued verbal warnings to Acker that the conditions in the barn needed to be improved or he would be cited for multiple violations.

On Nov. 8, after determining that the conditions had not been improved and obtaining a warrant to enter the property, the Officer went to the barn, found no improvements had been made, and with only a small heater to warm the entire barn, checked the room temperature which she found to be 30 degrees fahrenheit. At that point she placed Mr. Acker under arrest, read him his Miranda rights, and with the assist of a State trooper, took Acker into custody.

Over all these years Acker has bilked probably hundreds if not thousands of unknowing people of hundreds of thousands of dollars by misrepresenting the quality and health of these dogs, and never making refunds for any reason.

I would like for all people who care for animals to make a statement on December 12 at the Litchfield Green, across from the courthouse, (Litchfield Judicial District Superior Court, 15 West Street, Litchfield, CT 06759. Directions)  and picket and demonstrate that this man cannot be allowed to walk away with a slap on the wrist, a suspended sentence and community service. A true community service would be to put him and others like him out of business. State Law provides $5,000.00 fines and/or 5 years in prison for each count of felony animal cruelty. In Acker's case, he would be facing $310,000.00 in fines and 310 years in prison.

The only person in the United States, who has gone to prison for animal cruelty was Michael Vick. Let's let the prosecutors and the judge in this case know that animal cruelty is not a minor offense.

No, not really.. alot of the Animals come to a shelter because they are either abandoned by their Humans, or something happened like their owner died, or had to move into someplace that pets werent allowed, or just gave up on them and booted them out into the street. Some come from homes where it was either feed the dog or feed the kid.. theres a whole lot of great dogs and cats in shelters that are only there because their Humans couldnt care for them. I will say though, there are also animals with behavioural problems in shelters too, some folks dont think twice about abandoning a dog or cat with aggression issues into a shelter. thats why I always say, meet the Animal, introduce it to every member of your house hold, Including pets you already have... and get to know it for awhile before adopting it. so many folks just pick a dog, adopt it then find out its not a good fit and either turn it lose or bring it back. Like its a game or a piece of clothing thats too small!

Connie, you are absolutely right! I didn't mean to paint all rescue dogs in a broad stroke like that. There are so many dogs who would be extremely grateful to have a warm home. I rescued one adult dog out of an abandoned fenced in junkyard in Bpt. He was starving, skinny, bug ridden and his collar was embedded into his neck, the skin had grown around the collar. Having had such a terrible existence, he should have been a mean angry dog. Instead, this dog was the most loving animal i had ever had, he would have taken a bullet for me, jumped in front of a speeding train for me. His loyalty was without question. I have a framed picture of Rusty on my bedside.

Great advice... check on pet finder . com for rescues in your area. I hate to say it but try not to get one off the street or craigslist or the want adds. get one from a reliable rescue and not a breeder. Ya know, I am surprised at how many people will say; but if i get one from a rescue or shelter, How do I know its NOT from a breeder? I say, well, you dont.. but at least you will know you aren't giving the breeder anymore business by giving them another sale. The best way to stop back yard breeding is to take away their business. with so much of this stuff going on, there wont be a normal healthy breed left anywhere in the years to come. Look at all the breeds now. name one who doesn't have some sort of genetic abnormality. Unless you can find someone who specializes in a certain breed, has all the correct paperwork and certificates and licenses.. is inspected regularly and has a great reputation they would like to keep. id say you'd be pretty hard pressed to find a healthy, disease free pet with absolutely no issues.

One of my dogs is from some moron breeder in Georgia who bread two dogs (one Aussie and one black and white border Collie) together most likley trying to get some all white puppies.. well, he almost suceeded but wound up with an almost all white, simply beautiful, totally deaf dog with a degenerative eye disese thats going to lead to her being blind one day! Because most all of these dogs, born with very little coloring around their heads and ears are born deaf, they are nick named "Lethal Whites" because they will most times be euthanized at birth because, who wants to pay upward of $600.00 for a deaf, blind or both, dog? its a sad, crazy world we live in.

To: MH Griffin et al: the information being posted concerning Mr. Acker is wrought with inconsistencies and fabrications. A fair warning to all those willing to so eagerly jump on the band wagon of hatred before getting the facts straight. Mr. Acker was not handcuffed at the barn, nor was he arrested contemporaneously with the incident in which an animal control officer allegedly recorded a thirty degree temperature inside the barn... he was actually arrested days later in my presence in the Litchfield Court without incident. And as for the idea of protest at the commencement of his "criminal trial"... have fun. The "trial" you are referring to is a civil hearing on the continuation of an injunction ordered by a judge regarding temporary custody of animals- it has absolutely nothing to do with a criminal trial or criminal charges, something I am sure none of these bloggers or readers could possibly understand without legal training.. Wow – way to drum up support for Mr. Acker and endear yourself to the general public. I hadn’t realized that a hearing on an injunction was such complicated stuff. I’ll just have to trot off to law school for the next few years so I can understand all this voodoo you are convinced mere mortals such as myself cannot understand.

Deja Vu all over again...I was one of the people picketing the puppy mill outlet store True Breeders on rt 7. The experience was an eye opener. Before I thought most normal folks understood that dogs require basic things like food, shelter, care. I thought most educated people knew puppy mills were awful. Obviously not and many of the unenlightened have access to this forum and live in this town. So please go ahead and rip away at each other and I will simply show up at the courthouse to support the protesters. I hope Mr. Acker, and those like him get the full sentence under the law. From what I have heard people in lock-up hate two kinds of people: child molesters and animal abusers.

SOME PEOPLE NEED TO STOP SEEKING STATUS BY BUYING PURE BREEDS!!!! SNOBBERY IS OFTEN WHAT PERPETRATES ABUSE AND DAMAGE TO THE LINEAGE OF THESE BREEDS. Search articles on what breeding has done to the health of purebreds. - If people would simply show some compassion and consider saving a dog from a shelter, less of these incidents would happen. - Or, if you simply MUST have a purebreed, get him/her a companion of mixed breed for company, (and as a source of intelligence sharing). - I adore MANY of the purebreeds, but the reality is, the mixed breeds I've owned have been HEALTHIER, happier, smarter and have lived longer tham my purebreeds, (that I never paid for, but found at specific rescues).

I adopted my dog from Fred, and he has been the light of my life. He had been abused and abandoned in South Carolina; I have the documentation to prove it. I have the vet reports to show that he was neutered and received all the proper vaccinations. Fred saved many, many dogs from euthanasia in the fast-kill shelters of the South. He has put every penny of his own money into his shelter, and only donations have kept it going. Without his shelter, hundreds of dogs will die. Yes, it's not the prettiest shelter, but there is a lot of love there. My dog wouldn't stop licking Fred when we came to adopt him. I saw Fred spending time with all of the dogs, and they all seemed to love him. Please don't judge him so quickly. You should be helping him instead of condemining him!

To: Ms. McQuaid : I appreciate that you identify yourself. I am not the prosecuting attorney in this case. What I know of Acker, I've known for over 20 years. I also know that he has been arrested, regardless of the circumstances, for doing things and breaking the law regarding animal cruelty that he has been doing for over 20 years. The court could not contain the amount of people who have been conned by this man and, the amount of animals who have been mistreated and abused by him. I am not trying to judge Acker, I'm only judging what I know to be true. Whether anybody joins me, I will be on the Green in Litchfield, on Wed. Dec. 12 at 9:00am. I'll be wearing a Stetson cowboy hat. HEY!,HEY!, HO!,HO!, OLD FRED ACKER'S GOT TO GO.

@ Wendy I always get my top of the line dogs from area pounds. But they are expensive. Can you imagine they cost like 10 bucks. Now that is over the top for a top of the line Dog. But some how they love you more as i think they know they have been rescued.

Sadie,why don't you read all the posts about Acker and google his name.You will be able to see that time after time there are problems with him and his so called "rescue".He keeps cages full of dogs that many are too small for them,they are often and usually stacked on top of one another.Maybe it takes a person that has been an ACO to help inform about a person like this.As for the Stratford AC,that was not dissipated...the double billing that he brought attention to ,was found to be true,and supposedly the town was reimbursed.He was thanked for catching that.There are still may questions that are to be answered about how things are being run at the shelter.Now about his time as ACO....why does he have awards and a commendation from the town for his service??

I tried to stop myself. I really did, but I can’t. So with apologies to everyone, except Alice of course. “Contemporaneously” – that’s a fancy word. Reminds me of a line from Blazing Saddles. “Ms. McQuaid, you use your tongue prettier than a twenty dollar…” Is that one of the words they teach you at lawyer school to make you think you are smarter than other people? Me, I would have said he wasn’t arrested at the time of the (alleged) incident. But that wouldn’t look so impressive on the billing: Told the people you weren’t arrested at the time of the (alleged) incident. $5.00 Used the word “Contemporaneously” in an online blog. $150.00 Now I’m just simple folk so me and my brother Billy Bob Joe Bob are gonna head up to the still and contemporaneously figure out if we going to have coon or possum for dinner tonight. Maybe we’ll have both. Ain’t that purty?

What was the fate of these dogs if Acker was not involved? Where did they come from, where would they have ended up, etc. It seems to me Acker is a scapegoat for a much larger issue, and the real problem is nothing being solved.. Does anyone know where these animals originated from and why? I agree with BillandSusan: for years I have driven by a house in Naugatuck where 2 dogs are in doghouses right in the front yard no matter what the temperature and weather. I have a neighbor who chains his dog outside when they are away for hours, and I am serenaded with a barking, whining dog as the temperatuer drops and the sun goes down. And that poor animal does not even have a doghouse, barn, nothing. Why are we not outraged about this?

Please do not condemn people who buy purebed dogs. I have owned at least 12 adult shelter dogs in my life so far. I also own a purebred Golden Retriever that I bought from a reputable breeder who cares about the health and welfare of her dogs. I agree that breed standards imposed by the AKC and UKC have in many cases ruined breeds of dogs. LUnreputable breeders also have ruined breeds of dogs. You may have been able to get your purebreeds at specific rescues because of the unreputable breeders who sell pups to anyone and then many end up in rescues and shelters. I am tired of people saying to me "Oh you didn't get her at a shelter? I rescued a dog from down south myself." I bought from a reputable breeder, am a responsible dog owner and have former shelter dogs too. Please don't hate me for buying a purebred dog.

Alice - We will be happy to protest at the civil hearing so he does not get custody of any of these animals. Does it really matter when/where he was arrested? Not really. What matters is that he was arrested. If my attorney posted about my case on a public forum, I would fire the incompetent lawyer immediately. Where are your brains?

I used to work at this facility. I spent countless hours a week cleaning and caring for dogs that would most likely be better off any where but there. The stench inside is horrendous. When there were more dogs than could fit in the house, they were stuffed in crates in a falling down old garage. The dogs lacked proper human interaction and socialization. However when the power was out for a week due to a storm, Mr. Acker stayed in a luxury hotel while us workers didn't even have water to clean with. We couldn't clean food bowls or cages properly. Mr. Acker cares about one thing and that's the almighty dollar. I'll bet he couldn't tell you the names of 5 dogs he has...
